Terms of Service

Last updated: November 1, 2026

These terms apply to your use of Level Up Performance, run by Level Up Performance App Inc. ("Level Up Performance", "we", "us"), based in Toronto, Ontario, Canada. By creating an account or using the app, you agree to them. If you don't agree, don't use the app.

Who can use Level Up Performance

You must be at least 13 years old to create an account. We don't knowingly collect information from children under 13; if we learn we have, we delete it. By creating an account you confirm you're 13 or older.

Accounts

You're responsible for your account and for keeping your sign-in details secure. Information you provide must be accurate. Tell us right away if you think someone else is using your account.

Subscriptions and trials

Some plans are paid. Paid plans may start with a free trial; the trial length and price are shown before you confirm. A card is required to start a trial and you'll be charged when it ends unless you cancel first. Plans renew automatically until cancelled. Prices are in US dollars and taxes may be added where required.

You can cancel any time in Settings. You keep access until the end of the period you've paid for. Payments aren't refunded for partly used periods, except where the law requires it. If you're on a team or use a code, the team or code covers your access and you aren't charged.

Teams, coaches and trainers

When you join a team, your team's coaches can see some of your information, as described in our Privacy Policy. Coaches and trainers are responsible for how they use athlete and client information and must use it only to coach or train those athletes, and in line with any rules that apply to them (for example, their school or athletic association's rules).

A team's owner manages the team's plan. If the team is deleted, the team's plan is cancelled. If a player deletes their account, they leave the team and the team's plan carries on.

Trainer payments and the platform fee

Trainers set their own prices for clients and are responsible for the services they provide. Client payments are processed by Stripe to the trainer's connected account, under Stripe's terms. Level Up Performance keeps a platform fee of 0% of each paid trainer subscription, after discounts. Refunds for trainer services are between the client and the trainer.

Your content

You keep ownership of the data you enter. You give us permission to store and process it to provide and improve the service, including using de-identified training data (data that no longer identifies you) to make our tools better, as described in our Privacy Policy.

Account deletion

You can delete your account in Settings at any time. See our Privacy Policy for what's removed and what's kept.

Health disclaimer

Level Up Performance provides training and planning tools and is not medical advice. Consult a qualified professional before changing your training, nutrition or health routine. You use workouts and training plans at your own risk.

AI disclaimer

AI answers and recommendations are informational, based on the data available, and may be inaccurate. They are not medical, health or professional advice. Check anything important with your coach or a qualified professional.

Third-party services

Some features rely on third parties, including payments (Stripe), AI models (OpenAI and Google, through our AI provider), voice (ElevenLabs) and demo booking (Calendly). Their own terms apply to your use of them.

Acceptable use

Don't misuse the service, try to access other people's data, copy or resell the app, or interfere with how it works. We can suspend or close accounts that break these terms.

Changes to the service and these terms

We may change or stop features. If we change these terms in a meaningful way, we'll update the date above and tell you in the app or by email. Continuing to use the app after a change means you accept it.

No warranty

The app is provided "as is" and "as available". We work to keep it accurate and running, but we don't promise it will be error-free, always available, or that it will improve your results.

Limitation of liability

To the extent the law allows, Level Up Performance isn't liable for indirect, incidental or consequential losses, or for lost data, profits or results. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or CA$100 if you haven't paid us anything. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts in Toronto, Ontario, unless the law where you live gives you the right to bring it elsewhere.
